Sally also edits the Children Law section of the Encyclopedia of Social Services and Child Care Law(Sweet and Maxwell).

AREAS OF PRACTICE

  • SEND Law: Sally has experience of representing parents and local authorities before the SEND Tribunal. She is passionate about securing the right educational provision for children with special educational needs and disabilities. She has a particular in-depth knowledge of specific learning difficulties and of different forms of neurodiversity.

In addition to Tribunal representation, Sally is able to advise on case preparation in advance of Tribunal hearings. This includes: -

  • Applications for an EHC Needs Assessment (EHCNA Request)
  • Knowing how and when to appeal
  • Preparation for a Tribunal hearing (with or without full representation)
  • Advice on preparing the Working Document.

This is an area which lends itself in particular to representation through Direct Access.

  • Private Law Children: Sally has vast experience acting on behalf of parents and children in private law children matters, even in the most complex of disputes such as those involving alleged parental alienation and / or serious allegations of abuse. She has represented parties at all levels including in the Court of Appeal. Her experience in public law matters mean that she is particularly experienced dealing with cases where there is alleged substance misuse, domestic abuse, coercive and controlling behaviour and allegations of physical/emotional/sexual harm. This includes representation at lengthy fact-finding hearings where appropriate. She also takes on cases involving the proposed (domestic or international) relocation of children with a parent / other family member.
  • Public Law Children: Sally represents local authorities, parents and children in all levels of Court and aat all types of hearing in care matters. Her work includes cases of alleged non-accidental injury, including child fatalities. She has extensive experience of cases involving mental ill-health, parental substance misuse and child sexual abuse. Sally has particular experience and knowledge of issues around children with disabilities and all forms of neurodiversity.
  • Financial remedies: Sally’s financial relief practice encompasses all aspects of matrimonial finance and cohabitation disputes including Schedule 1, Children Act claims.
  • Judicial Review: Sally has a particular interest in judicial review proceedings as they relate to public law children work. The second edition of her book on Part III, Children Act, ‘The Children Act 1989: Local Authority Support for Children and Families’ was published by Jordan Publishing in November 2015. She regularly advises and represents claimants and local authorities in judicial review claims relating to the Children Act. She has a particular knowledge of the duties of local authorities under s.17 and s.20, Children Act 1989, the Children (Leaving Care) Act 2000, fostering / special guardianship payments and the duties owed to looked after and former looked after children.
